The damn pilots use the phone while they are in the cockpit and nobody sees it. If the pilot or co-pilot was on a call during take-off or landing, nobody (at least not anyone that would saying anything about it) would know. I've read that it has been proven that cell phones do not affect aviation electronics. Period. The rule is just a dumb power trip of the FAA.
